Q26. Can I give up my Executive Condominium (EC) Unit after I have taken possession of it but within the 5-year occupation period?
A26: Owners are not allowed to dispose of their EC Units before the expiry of the 5-year minimum occupation period as it will be an infringement of the Executive Condominium Housing Scheme Act Cap 99A.
Q27. What will happen if an owner of Executive Condominium Unit infringes the Executive Condominium Housing Scheme Act Cap 99A?
A27: If an owner infringes the Executive Condominium Housing Scheme Act Cap 99A or its relevant Regulations, his Executive Condominium Unit may be compulsorily acquired. The compensation payable to the owner will be in accordance with the Executive Condominium Housing Scheme (Compensation & Order of Priority) Regulations 1996.
Q28. Can an owner sublet the bedrooms in his Executive Condominium (EC) Unit?
A28: During the 5-year minimum occupation period (MOP) which is computed from the Temporary Occupation Permit date, an EC owner and other members stated in the application must be in continuous physical occupation of the EC Unit. He may however sublet the other bedrooms in the unit but he must retain at least one bedroom for his own physical occupation. He must register the subletting of bedrooms with HDB within 7 days of doing so. He is also required to notify HDB when he renews, or terminates the subletting of bedrooms, and when there are changes to his subtenants’ particulars. He may approach the HDB Branch Office managing his EC to register the subletting.
The EC owner can only sublet his entire EC Unit after the 5-year MOP.
Q29. Can I buy or invest in private residential property in Singapore/overseas after I have bought an Executive Condominium (EC) Unit?
A29: You cannot buy or invest in private residential property in Singapore/overseas from the time of your EC Unit application to the expiry of the 5-year minimum occupation period (MOP). The MOP is computed from the Temporary Occupation Permit date of the EC Unit (excluding the subletting of whole flat and any period of non-occupation). You can buy private residential property in Singapore/overseas only after the expiry of the 5-year MOP.
Q30. When can I sell my Executive Condominium (EC) Unit in the open market?
A30: You can sell your EC Unit in the open market to Singapore Citizens or Singapore Permanent Residents after the 5-year minimum occupation period which starts from the Temporary Occupation Permit date in respect of the EC Unit. However, you can sell it to any person after 10 years from the Temporary Occupation Permit date.
